Terms of Service

Effective date: August 25, 2025

These Terms of Use ("Terms") govern your access to and use of the CarFlow AI website, mobile applications and related services (collectively, the "Service"). Please read them carefully. By accessing or using the Service, you agree to be bound by these Terms.

1) Service Provider

The Service is operated by:

2) The Service

CarFlow AI is a global SaaS platform that allows users to:

  • Upload photographs of vehicles,
  • Edit and enhance them with AI (background removal/replacement, shadow/reflection generation, license plate anonymization, etc.),
  • Generate car advertisement descriptions,
  • Manage and download processed media.

The Service is available for individual (B2C) and business (B2B) users such as car dealers, resellers and agencies.

3) Eligibility

  • You must be at least 18 years old (or the legal age of majority in your jurisdiction).
  • By using the Service, you confirm you have the necessary rights and permissions to upload and process the content (e.g. you own the car photo or have consent from the rights holder).

4) User Content

4.1 Ownership

You retain all ownership rights to the images, text and other materials you upload ("User Content").

4.2 License to CarFlow AI

By uploading User Content, you grant CarFlow AI a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to:

  • host, store, process, reproduce and display the content,
  • use it as necessary to operate, maintain and improve the Service (including AI model training, security and research & development).

We will never sell your User Content to third parties.

4.3 Prohibited Content

You may not upload content that is:

  • infringing on third-party intellectual property rights,
  • containing personal data (faces, ID numbers, phone numbers, license plates unless anonymized),
  • illegal, offensive, pornographic, violent, discriminatory or misleading,
  • or any material you do not have legal rights to use.

CarFlow AI reserves the right to moderate, remove or block such content and suspend related accounts.

5) Payments and Subscriptions

  • Payments are processed via Stripe, Inc.. We do not store your card details.
  • Subscriptions automatically renew unless cancelled before the renewal date.
  • You may cancel anytime; cancellation takes effect at the end of the current billing period.
  • Fees are non-refundable once a generation is completed, except where required by law.
  • We may adjust pricing with prior notice; changes apply to future billing cycles.

6) Data Retention and Account Deletion

  • You may delete your account at any time through account settings or by contacting us.
  • Upon deletion, your personal data will be erased or anonymized, except as required by law (e.g. invoices).
  • Original uploads are retained for 30–90 days (configurable) to allow re-processing and support.
  • Processed outputs remain available while your account is active, or until you delete them.

7) Service Availability and Fair Use

  • We use reasonable efforts to ensure availability of the Service, but it is provided "as is" and "as available".
  • Planned maintenance or urgent security updates may temporarily limit availability.
  • To prevent misuse, we may apply fair usage limits (e.g. maximum images per account, storage limits, rate limits).
  • Abuse, fraudulent activity or automated scraping may result in suspension or termination.

8) Limitation of Liability

To the maximum extent permitted by law:

  • CarFlow AI / SPEKTR is not liable for indirect, incidental, consequential, special or punitive damages (e.g. loss of data, revenue or business opportunities).
  • Our total liability under these Terms is capped at the amount you paid us in the 12 months preceding the claim.
  • We disclaim warranties regarding uninterrupted operation, specific output quality or compatibility.
  • You remain fully responsible for your User Content and any use of generated materials (e.g. car listings).

9) Feedback

If you provide suggestions, comments or ideas ("Feedback"), you grant CarFlow AI a perpetual, worldwide, royalty-free license to use and incorporate such Feedback into our Service without restriction or obligation.

10) Termination

We may suspend or terminate your account if you:

  • violate these Terms,
  • abuse the Service,
  • or upload prohibited content.

Termination does not release you from outstanding payment obligations.

11) Governing Law and Jurisdiction

  • These Terms are governed by the laws of Poland.
  • Disputes will be resolved by competent courts in Warsaw, Poland, unless mandatory consumer protection laws in your country provide otherwise.

12) Changes to the Terms

We may update these Terms from time to time. Updates will be posted on the Service and take effect upon posting. If the changes materially affect your rights, we will provide additional notice (e.g. via email or in-app notification).
